Restitution of $40 Million Net Worth


As a result of the surfeit of crimes perpetrated by Morgan Stanley against Spencer C. Young, there has been an aggregate theft of assets and an unlawful deprivation of a livelihood, which is currently estimated to be $40 million, as derived below.  This is obtained by taking a simple average of two entirely different methods, as reflected below, and summarized as follows:
  • Method I -- This takes precisely derived and empirically supported valuations of assets and the low end of the range of total annual income earned in the five years preceding Morgan Stanley's 2002 employment fraud, and adjusting for inflation using the U.S. Consumer Price Index for Urban consumers ("CPI-U"); and 
  • Method II -- This uses the detailed Proforma Net Worth derived in 2008 and an estimate of the net proceeds that were expected from civil claims against Morgan Stanley for employment fraud, and a variety of  other crimes perpetrated in its cover-up efforts, the full extent of which was not known.

This estimated loss of net worth is conservative when considering the extent of Morgan Stanley's malicious tortious interference in illegally denying the launch of Project Atlas, which would have exposed the original employment fraud that began this mess, as the business heads of Morgan Stanley's key CMBS clients had agreed to work for Mr. Young on what was once an exciting business opportunity with substantial upside.  It also does not take into account :  (a) the pain and suffering Morgan Stanley has continued to inflict upon Mr. Young and his family in its ongoing cover-up efforts; nor (b) the substantial punitive damages Mr. Young is seeking on behalf of, and for the benefit of others victimized by banking abuses, exceeding $2.5 Billion.
